These terms and conditions explain the rules that apply when you order from Royal Delites or use our website. Please read them before you place an order. By placing an order or using the website, you agree to them. If you do not agree, please do not use the website.
Who we are
Royal Delites runs this website. We are a bakery in Nairobi, found on Aerodrome Road close to Nyayo Stadium. In these terms, “we”, “us” and “our” mean Royal Delites, and “you” means the person using the website or placing an order. How we look after your personal information is explained in our Privacy Policy.
Using the website
- You must be 18 or older to place an order, or have a parent or guardian place it for you.
- Give us correct and complete information, especially your phone number and delivery address, so that we can reach you and deliver your order.
- If you create an account, keep your password private. You are responsible for what is done through your account, so tell us at once if you think someone else has used it.
- Do not misuse the website, for example by trying to break into it, overloading it, copying its content to run a competing business, or placing orders that you do not intend to collect or pay for.
- We may suspend or close an account that is used in these ways.
Our cakes and other products
Our cakes and bakes are made fresh. Each one is made by hand, so it may differ a little in colour, shape and decoration from the photographs on this website. The photographs show you what to expect and are not an exact promise of how your cake will look.
Descriptions, sizes and options are shown on each product’s page. Many of our cakes are priced by weight, so you choose a size in kilograms when you order. Some products have a minimum order, which is shown on the product page. Please check the size, flavour and any other option before you add a product to your cart.
Prices and payment
- Prices are in Kenya shillings (KSh). The price you pay is the price shown to you at checkout, which also shows any delivery charge we have confirmed.
- Delivery fees depend on where you are. If the fee is not shown at checkout, we will confirm it with you before we deliver.
- If we find that a price on the website is wrong, we will tell you before we make your cake, and you can choose to go ahead at the correct price or to cancel.
- You pay by one of the methods offered at checkout. If you choose to pay when you collect or receive your order, payment is due at that moment.
Placing an order
When you place an order, the website sends you an automatic message to show that we have received it. That message is not our final acceptance. We then check that we can make your order for the date and with the details you asked for, and we will contact you if we cannot. Your order is confirmed when we tell you it is.
We may decline or cancel an order if, for example, we cannot make it in time, an item is unavailable, or we cannot reach you to confirm the details. If we do, we will tell you, and we will refund anything you have already paid for it.
Date and time
At checkout you choose the date you need your order and a time of day: morning, afternoon or evening. We will do our best to match it, but a time of day is not an exact appointment, and we will confirm the arrangements with you. Cakes take time to make, so please order as early as you can. If your date is too close for us to manage, we will say so.
Pickup and delivery
- Pickup: you collect your order from our bakery on Aerodrome Road, Nairobi, at the time we agree with you.
- Delivery: we deliver to the address you give us. Please make sure it is correct and complete and that someone can receive the order. If nobody is available, or we cannot find the address, we may not be able to complete the delivery, and we will contact you to arrange what happens next.
- Please check your order when you receive it, and tell us straight away if there is a problem.
- Once your order is handed over, it is up to you to keep it safe and fresh. Anything made with fresh cream, custard or fruit must be kept cold. Storage tips are in our article How to Store a Cake So It Stays Fresh.
Allergies and dietary needs
If you or anyone eating your order has an allergy or a dietary need, tell us when you order, using the allergies box at checkout, and ask us any questions about ingredients before you buy. We will do our best to follow what you tell us.
Our cakes are made in a kitchen that uses ingredients including wheat, eggs, dairy and nuts, and some cakes contain alcohol. For that reason we cannot promise that any product is completely free of traces of an ingredient, even when it is described as sugar free or wheat free. Those descriptions refer to the recipe. They are not medical advice, and they are not a guarantee for anyone with a severe allergy or a medical condition. If your health depends on it, please speak to us first, and to your doctor.
Messages, designs and photo prints
- You can ask for a short message on a cake. We will do our best to write it exactly as you give it, so please check your spelling. The website shows the length allowed.
- We may decline a message or design that is offensive, unlawful, or that copies someone else’s protected work or trademark.
- If you ask us to print a photograph or design on edible paper, you confirm that you are allowed to use it. We cannot be responsible if you do not have that right.
Changing or cancelling an order
If you need to change or cancel an order, contact us as soon as you can by sending a message through our Contact page. Because we make each cake fresh for you, we may not be able to change or cancel once we have started on it. We will tell you honestly what is possible. If you cancel in good time, we will refund anything you have paid for that order.
If something is wrong
We want you to be happy with your order. If it is not as described, is damaged, or is not what you ordered, please contact us as soon as possible, ideally on the same day, and include your order number and a photograph if you can. We will look into it promptly and work with you to put it right. If it is safe to do so, please keep the cake until we have replied.
Nothing in these terms takes away any right you have under Kenyan law, including the Consumer Protection Act, 2012.
Our responsibility
- We are responsible for loss or damage that is a foreseeable result of us failing to take reasonable care or to keep to these terms.
- We are not responsible for a delay or failure caused by something outside our reasonable control, such as a power cut, severe weather, traffic disruption, or a supplier failing to deliver.
- We are not responsible for a problem that happens after handover because a cake was stored or handled in a way that did not suit it, or because information you gave us, such as an address or an allergy, was wrong or incomplete.
- Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit.
Website content and links
The text, logo, design and photographs of our own cakes on this website belong to Royal Delites or to the people who license them to us. You may view and share pages for your own personal use, but you may not copy or reuse them commercially without our written permission.
The website links to other sites, such as Instagram, Facebook and Google Maps. We do not control them and are not responsible for what they contain.
Changes to these terms and conditions
We may update these terms and conditions from time to time. The version shown on this page on the day you place an order is the one that applies to that order.
Law and disputes
These terms are governed by the laws of Kenya, and the courts of Kenya can deal with any dispute about them. If you have a complaint, please contact us first. We would much prefer to sort it out with you directly.
Contact us
If you have a question about these terms or about an order, send us a message through the Contact page, or come and see us at the bakery.
